Terms of Service

These Terms of Service are a legal agreement between you and Umbra Global LLC, doing business as Outglow ("Outglow," "we," "us," or "our"). These Terms govern your use of the Outglow mobile app, API, websites, admin tools, and related services.

By creating an account, accessing the app, uploading content, or using the service, you agree to these Terms and the Privacy Policy.

Eligibility

You must be at least 13 years old, or the minimum age required in your country or region, to use Outglow. You must provide accurate country and date-of-birth information at signup. If you are not old enough to use Outglow, you may not create an account or use the service.

Accounts

You are responsible for your account credentials and account activity. You must provide accurate information, keep your account secure, verify your email when required, and promptly tell us if you believe your account has been compromised. You may not impersonate another person, create misleading accounts, evade enforcement, sell or transfer your account, or create accounts for spam, fraud, scraping, manipulation, or abuse.

Email Verification And Security

We may require email verification before allowing access to posting, voting, messaging, or other features. We may revoke sessions, rotate tokens, reset passwords, or require additional verification when needed to protect accounts, users, or the service.

User Content

You retain ownership of content you upload or submit. You grant Outglow a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, copy, process, display, distribute, publish, adapt, moderate, remove, analyze, and promote your content as needed to operate, secure, improve, and market the service, including feeds, profiles, battles, voting, leaderboards, notifications, ads, discovery, safety, and moderation features.

You represent that you have the rights needed to upload your content and grant this license. You are responsible for your content and for any harm caused by content you submit. Do not upload content that infringes rights, violates law, violates privacy, or violates these Terms.

Public Content And Direct Messages

Posts, profiles, battles, reputation, badges, counts, and some activity are public or visible to other users. Direct messages are visible to conversation participants. Direct messages are not end-to-end encrypted and may be accessed by authorized staff when needed for safety, abuse investigations, reports, legal compliance, or platform integrity.

Battles, Votes, Reputation, And Rewards

Battles, votes, rankings, badges, reputation, and rewards are platform features, not money or property. They may change over time. We may adjust, reject, remove, or recalculate votes, battles, rankings, reputation, rewards, or visibility when we detect abuse, fraud, technical errors, policy violations, coordinated behavior, suspicious voting, or moderation issues.

Moderation And Enforcement

We may review, reject, remove, limit, demote, preserve, or disable content; cancel or restore battles; adjust rankings or reputation; limit features; suspend or delete accounts; preserve evidence; respond to reports; and cooperate with lawful requests when needed for safety, compliance, or platform integrity. We are not obligated to monitor all content, and failure to enforce one violation does not waive our right to enforce later.

Reports And Safety

You may report users, posts, battles, messages, or other content. Reports must be made in good faith. We may use user reports, automated safety scans, evidence snapshots, moderation notes, and account history to investigate potential violations.

We aim to triage every report of objectionable content within 24 hours of receipt and to action confirmed violations promptly. Reports tagged child safety (CSAE / CSAM) are routed into a dedicated priority queue and acted on first; the full pipeline is described in our Child Safety (CSAE) Standards.

Appeals

If we remove your content or restrict your account, you may appeal in writing to support@outglow.live within 30 days of the decision. We will review the appeal on its merits and notify you of the outcome. Confirmed CSAE removals are not reversed; honest mistakes are reversed and the account is restored. Appeals are independent of any out-of-court dispute settlement bodies you may also be entitled to use under applicable law, including under Article 21 of the EU Digital Services Act.

Ads And Sponsored Content

Sponsored entries and ad placements may appear in the service. Ads should be labeled where required. Users, advertisers, and partners may not generate invalid clicks, impressions, views, reports, or engagement. We may reject, remove, pause, or limit ads or ad accounts for policy, safety, legal, or quality reasons.

Account Deletion And Termination

You may request account deletion through Settings or by contacting us. Deletion may be scheduled with a grace period so accidental requests can be canceled. We may suspend, terminate, or restrict your account if you violate these Terms, create risk, or use the service unlawfully. Data handling after deletion or termination is described in the Privacy Policy.

Outglow Rights

Outglow, including our names, logos, designs, software, systems, and service features, is owned by Umbra Global LLC or its licensors and is protected by law. You may not copy, modify, distribute, sell, or exploit our service or intellectual property except as allowed by these Terms or by law. If you send us feedback, you allow us to use it without restriction or compensation.

Copyright And Intellectual Property Complaints

We comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). To report alleged copyright infringement, follow the procedure described in our DMCA Policy, which lists our Designated Agent and the six elements your notice must include to be effective. Counter-notices are described in the same policy.

Trademark, publicity, and other non-copyright rights complaints can be sent to support@outglow.live. Include enough information for us to identify the content, understand the rights at issue, contact you, and evaluate the request.

Third-Party Services

Outglow may integrate with third-party services such as hosting providers, databases, email providers, push notification services, app stores, analytics, crash reporting, and advertising providers. Your use of those services may also be subject to their terms and policies. We are not responsible for third-party services that we do not control.

Mobile App Stores

If you download Outglow through Apple, Google, or another app store, your use of the app may also be governed by that store's rules. The app store provider is not responsible for providing maintenance or support for Outglow unless required by its own terms or applicable law.

Availability And Changes

Outglow is provided as-is and may change, pause, limit, or stop at any time. We may add, remove, or alter features, limits, ranking systems, rewards, moderation policies, ad products, and eligibility requirements as we improve the product or comply with law, provider rules, and platform requirements.

No Guarantee Of Content Preservation

We do not guarantee that content, accounts, messages, battle records, rankings, rewards, notifications, or media will always be available, preserved, recoverable, or error-free. You should keep your own copies of content that matters to you.

Disclaimers

To the fullest extent allowed by law, Outglow and its service providers disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and uninterrupted operation. We do not guarantee that content, rankings, battle outcomes, recommendations, rewards, messages, or notifications will be accurate, available, or preserved.

Limitation Of Liability

To the fullest extent allowed by law, Outglow and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, loss of goodwill, reputational harm, account loss, content loss, or service interruption arising from or related to your use of the service. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

Indemnity

To the extent allowed by law, you agree to defend, indemnify, and hold Umbra Global LLC, Outglow, and our officers, managers, members, employees, contractors, service providers, and agents harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, your use of the service, your violation of these Terms, or your violation of another person's rights.

Governing Law And Venue

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules, except where applicable consumer or local law requires otherwise. To the extent a dispute is not required to be handled elsewhere by applicable law, you and Outglow agree to the personal jurisdiction and venue of the state or federal courts located in Wyoming.

Consumer And Local Law Rights

Nothing in these Terms limits rights that cannot be waived under applicable consumer, privacy, platform, or local law. If any part of these Terms is found unenforceable, the rest remains in effect.

Assignment

You may not assign or transfer these Terms or your account without our permission. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.

No Waiver

If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later. Any waiver must be in writing and signed by us.

Changes

We may update these Terms as the product changes. The effective date and legal version above identify the current version. Material changes may require users to accept updated Terms before continuing to use the service.
